Toshiba recommends taking a particular Windows 7 upgrade path by picking the appropriate link for your laptop here.
If you meant that the second character of your M400's serial number is '8', then the recommended process would be a clean install using this process.
If you prefer to do a manual in-place upgrade, follow the detailed instructions in the PDF document here.

Jim, the SECOND digit of her serial number is a 6 (SIX). It's the first digit that's an 8.

Do what it says to do. Start backing up all of your important data as fast as you can. That drive probably won't last much longer. You'll need to replace that drive as soon as possible, and I mean AS SOON AS POSSIBLE, I wouldn't wait more than a couple of days to do so. You might be able to replace it yourself or you can have a service center do it for you.

I've received this same message about Smart card predicted HDD Failure. Did you have to replace your hard drive or was it a simpler process???????? I may not be able to get mine changed on warranty so wondering if it would be costly to fix or if its a minor process

It isn't smart CARD, but a SMART error for the hard drive. ANd one you get a smart warning like this you normally only have a couple of days before the drive fails completely. Replacement hard drives can be purchased for as little as $50 but go up to several hundred depending on the type and size you get. Without knowing what you have and where you are from it's difficult to say for sure, but for the most part figure about $80 to $100 US to replace a hard drive if you can do it yourself. Depending on how much a shop charges that coule easily double by they time they add in their labor charge.
Depending on how technically savvy you are you can probably do it yourself, but you need to back the data up NOW. Not next week, but today.

I'm trying to upgrade to Windows 7 on my Toshiba Satellite. It wants me to uninstall HDD Protection, but it won't uninstall for some reason. Is anyone else having this problem?

Hi! Just had the same problem on my wife's machine. After uninstalled Toshiba HDD protection got the same result - not being able to continue upgrade. Then I searched trough registry and found a key showing driver for HDD shock sensor. Remember the name of inf file (mine was oem4.inf in windows/inf folder) and delete it (inf file). Then in Device manager under System devices uninstall entry with HDD shock sensor. The last thing to do is to delete sys file from Windows/system32/drivers folder called thpdrv.sys. And after that restart computer and start the upgrade again. Hope this helps.
